Service description

SWW.art is an e-commerce platform operated by Shorpo Research Inc. that enables artists and creators to sell artwork, prints, and digital goods to customers worldwide. We provide storefront hosting, payment processing, order management, and delivery coordination on behalf of sellers.

No warranty

This service is provided “as is” without warranty of any kind, express or implied. We make no guarantees regarding the accuracy, reliability, or availability of the service.

Service availability

We strive to maintain high availability but make no guarantees. The service may experience downtime for maintenance, updates, or unforeseen issues. We will make reasonable efforts to provide advance notice of scheduled maintenance.

Purchases and payments

All payments are processed securely through Stripe. By placing an order, you agree to pay the listed price plus any applicable taxes and shipping fees. Prices are set by individual sellers and may change without notice. We are not responsible for pricing errors by sellers.

Refunds and returns

Refund and return policies are set by individual sellers and displayed on their storefronts. If you have a dispute regarding a purchase, please contact the seller directly or reach out to us for assistance. We will make reasonable efforts to help resolve disputes between buyers and sellers.

User responsibilities

You are responsible for:

• Keeping your account credentials secure
• Providing accurate shipping and contact information
• Complying with applicable laws in your jurisdiction
• Not using the platform for any unlawful, fraudulent, or harmful purpose

Seller responsibilities

If you are a seller on SWW.art, you are responsible for the accuracy of your product listings, fulfilling orders in a timely manner, complying with all applicable consumer protection and tax laws, and ensuring that you have the right to sell the items you list.

Intellectual property

Sellers retain full ownership of the artwork and content they upload to SWW.art. By listing items on the platform, sellers grant us a limited, non-exclusive license to display and promote their products within the Services. We respect intellectual property rights and will respond to valid takedown requests.

Acceptable use

SWW.art is intended for the sale of artwork, prints, and creative goods. You may not use the service for any unlawful purpose, to sell prohibited items, or in any way that could damage or impair the service.

Termination

You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon account deletion, your personal data will be permanently deleted within 30 days, subject to legal retention requirements.

Data ownership

You retain full ownership of all data you upload or create on SWW.art. We will never sell, share, or monetize your personal data or creative content beyond what is necessary to provide the Services.

Limitation of liability

To the maximum extent permitted by law, Shorpo Research Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of SWW.art. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email or an in-app notification at least 14 days before they take effect. Continued use of SWW.art after the effective date constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-law principles. This choice of law does not deprive you of the protection afforded by mandatory consumer-protection provisions of the law of the country in which you reside. Your personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, the GDPR and other data protection laws.
